REASON FOR DECISION


1. B TASIKUL: You pleaded guilty to the charge of unlawfully assaulting Celine Maneo a colleague of yours. I note from the statement of facts and also from the community base officers reports on the circumstances, on how the offences was committed.


2. Briefly I noted that you and the victim had an argument earlier in the day at the police station. Your boss tried to have this matter mediated at the station but you never cooperated.


3. In that same evening, you invited the complainant to reconcile with her; however, instead you assaulted at her that time. You have not explained to this court the reason why you assaulted the complainant. However, from the community base officer’s report I noted that you were upset or jealous when you heard rumors that your boyfriend and the complainant were found drinking beer some previous days. This did not go down well with you. That is why you took such dramas tic action.


4. While I consider the complainant’s action with your boyfriend, inconsiderably and contentious, I do not think that was an appropriate way to deal with such matters. You are a policewoman, you have been trained not only to discipline but to apply self - discipline. You must exercise some self discipline in your personal life.


5. If you think those rumors about your boyfriend and the complainant was true, you should have taken other appropriate actions. You did not respect your superior while he or she tried to settle your problem at the police station.


6. To me this shows insubordination. As public officers, the public is watching us, we must be mindful of what we do even though if it is our private affairs. Your action, one way of other may have significant effects on the Police Services. We have very good policemen and women who try to rebuilt Bougainville and this type of attitude can not be entertained.


7. This matter should have not come to court if you have cooperated at the first place. Having said that however, I take into account your admission to the offence and also your no previous conviction. I have taken note of the report provided by the Probation Officer. In this respect I would therefore find you guilty and placed you on six (6) months Probation with condition to be on good behavior bond for six (6) months.


8. I noted that, the complainant has asked the court for compensation of K200.00 for injuries and humiliation she has suffered. I think she should shoulder half of the blame for creating this problem. I order that you pay her only K100.00 as compensation.
