AN ACT to amend the Nursing Act 1969.

[20 February 1981]

BE IT ENACTED by the Legislative Assembly of Western Samoa in Parliament assembled as follows:-

1. Short title - This Act may be cited as the Nursing Amendment Act 1981 and shall be read together with and deemed part of the Nursing Act 1969* (hereinafter referred to as the principal Act). * 1969, No. 8

2. Interpretation Section 2 of the principal Act is amended -

(a) by repealing the definition of "Director" and substituting the following definition:-

"Director-General' means the Director-General of Health:";

(b) by repealing the definition of "Superintendent".

3. Registrar of Nurses - Section 3 of the principal Act is amended by repealing "Superintendent" and substituting "Director of Nursing".

4. Board of Nursing constituted - Section 4 of the principal Act is amended -

(a) by omitting from paragraph (c) of subsection (2) the words "to be chosen and appointed by the Minister from a panel of 2 medical officers";

(b) by omitting from paragraph (d) of subsection (2) the words "to be chosen and appointed by the Minister from a panel of 5 registered nurses";

(c) by omitting from paragraph (e) of subsection (2) the words "to be chosen and appointed by the Minister from a panel of 2 registered midwives";

(d) by omitting from paragraph (f) of subsection (2) the words "by the Minister" and substituting "by the Head of State, acting on the advice of Cabinet"; and

(e) by omitting from subsection (3) the word "Minister" (where it first occurs) and substituting "Head of State".

5. Meetings of Board - Section 6 of the principal Act is amended -

(a) by repealing subsection (1) and substituting the following subsection:-

"(1) Meetings of the Board shall be held at least 3 times a year and at such times and places as the Chairman may from time to time appoint."; and

(b) by inserting after subsection (1) the following subsection:-

"(1A) It shall be the duty of the Director-General as soon as practicable to cause a special meeting of the Board to be called when requested to do so by a requisition n writing signed by any 3 members of the Board, specifying the business to be brought before the meeting.”

6. Approval of school for nursing education - Section 22 of the-principal Act is amended by inserting at the end of subsection (1) the words "or by a statutory corporation".

7. Only registered nurses, etc., to be employed - Section 26 of the principal Act is amended by inserting after the word "Department" the words "or by a statutory corporation".

8. Consequential amendments - The principal Act is further amended as specified in the Schedule.

9. Transitional - Upon the coming into operation of this Act any member of the Board previously appointed under section 4 of the principal Act shall remain in office until nominated in accordance with this Act or until his successor comes into office.
