AN ACT to amend the Legislative Assembly Powers and Privileges Ordinance 1960.

BE IT ENACTED by the Legislative Assembly of Samoa in Parliament assembled as follows:-

1. Short title and commencement-(1) This Act may be cited the Legislative Assembly Powers and Privileges Amendment Act 1998 and shall be read together with and deemed part of the Legislative Assembly Powers and Privileges Ordinance 1960 (the principal Act).

(2) This Act shall come into force on the date it is assented to by the Head of State.

2. Contempt by member of Assembly-(1) Section 21 of the principal Act is amended by adding subsection (1A) as follows:

"(1A) For the purposes of this section "Privileges and Ethics Committee" shall mean the Privileges and Ethics Committee of the Assembly appointed under the Standing Orders, by whatever title it be known."

(2) Section 21(2) of the principal Act is amended as follows-

(a) By deleting the words "appoint a select Committee" and replacing them with the words "refer the matter to the Privileges and Ethics Committee"; and

(b) By adding a semi-colon after the words "investigate the matter"

(3) Section 21(3) of the principal Act is amended by deleting the words "select Committee appointed in terms of subsection (2) of this section" and replacing them with the words "Privileges and Ethics Committee under subsection (2)".
