LABOUR (WORK PERMITS) (AMENDMENT) ACT NO. 13 OF 2013

An Act to amend the Labour (Work Permits) Act [CAP 187].

Be it enacted by the President and Parliament as follows-

1 Amendment
The Labour (Work Permits) Act [CAP 187] is amended as set out in the Schedule.

2 Commencement
This Act commences on the day on which it is published in the Gazette.

SCHEDULE
AMENDMENTS OF LABOUR (WORK PERMITS) ACT [CAP 187]

1 At the end of section 2
Add

“(5) The Commissioner of Labour may impose conditions on work permits being issued under this Act.”

2 After subsection 5G(1)
Insert

“(1A) In addition to subsection (1), a work permit may be revoked by the Commissioner of Labour if the holder of a work permit fails to comply with any condition of the work permit.”

3 After subsection 8(3)
Insert

“(3A) A person who is not satisfied with a decision of the Commissioner of Labour made under section 5G, may within 21 days of receiving the Commissioner of Labour’s decision, appeal to the Minister for the determination of his or her application according to the procedure set out in section 12.

(3B) The fee for an appeal under this section is VT30, 000.”

4 Section 12
Repeal the section, insert

“12 Appeals

(1) Any person aggrieved by a decision of the Commissioner of Labour may appeal to the Minister.

(2) The Minister may in his discretion confirm, modify, amend or rescind a decision or determine any application which has not been so determined by the Commissioner of Labour.”
