FORESTRY (AMENDMENT) ACT
NO. 21 OF 1994

An Act to amend the Forestry Act [CAP. 147].

BE IT ENACTED by the President and Parliament as follows: -

AMENDMENT OF CHAPTER 147

1. The Forestry Act [CAP. 147] is amended by inserting after section 33 the following new section:
   

"PROHIBITION AGAINST THE EXPORT OF LOGS

33A. (1) Subject to the provisions of subsection (2) no person shall export logs or flitches from Vanuatu.

(2) No licence issued under this Act shall permit the export of logs or flitches from Vanuatu other than logs or flitches from the species cocos nucifera.

(3) For the purpose of this section -

(a) "Logs and flitches" shall mean any timber which has not been processed into plywood, veneer or planks or finished products made there from or other products designated by the Minister by regulation with the approval of the Council of Ministers;

(b) "Planks" means sections of wood sawn on each plane having a maximum cross-sectional area of 400 square centimeters and of whatsoever length;

(c) Timber of the species santalum austro-caledonicum from which the outer sapwood has been removed shall not be considered a log or flitch and a licence may be granted for the export thereof."

COMMENCEMENT

2. This Act shall come into force on the date of its publication in the Gazette.
