Public Prosecutor v Jackson [2014] VUSC 32; CR 08 of 2013 (7 February 2014)
IN THE SUPREME COURT OF THE REPUBLIC OF VANUATU
Criminal Case No. 08 of 2013
(Criminal Jurisdiction)
PUBLIC PROSECUTOR
VS
WILFRED JACKSON
Coram: Mr. Justice Oliver A. Saksak
Counsel: Mr. Ken Massing for the State
Ms Jane Tari for the Defendant
Date: 7th February 2014
MINUTES
- This case was adjourned on Tuesday 4th February 2014 for Mention and/or Plea today because the whereabouts of the Defendant was not
known. The Prosecution sought the adjournment to make enquiries.
- Today Mr. Massing informs the Court that despite his efforts he is not in a position to assist the Court as to the whereabouts of
the Defendant. He therefore requests for an adjournment and for a warrant of arrest.
- Ms Tari informs the Court she is not in any better position to assist the Court. She says the Prosecution has not furnished her with
PI documents. She has no issue with the requests made by Mr. Massing.
- The Court decides that the requests for adjournment and for Warrant of Arrest be declined. This is a 2012 case. The matter was listed
twice in 2013 and the position has not changed since. To save costs to the State it is necessary that the case be dismissed today.
ORDER
- Accordingly, I order that this case be dismissed.
DATED at Luganville this 7th day of February 2014.
BY THE COURT
OLIVER A. SAKSAK
Judge
