Public Prosecutor v Nqwero [2012] VUSC 152; Criminal Case 89 of 2012 (7 August 2012)
IN THE SUPREME COURT
OF THE REPUBLIC OF VANUATU
(Criminal Jurisdiction)
Criminal Case No. 89/ 2012
PUBLIC PROSECUTOR
V
EFFIE NQWERO
Hearing: 7 August 2012
Before: Justice Robert Spear
Appearances: Tabisa Harrison for the Public Prosecutor
Eric Molbaleh for the Defendant
CONVICTION AND SENTENCE
- The defendant has been arraigned today and he has pleaded guilty to one charge of possessing cannabis.
- He was found by the Police with total of 18.1 grams of cannabis that he admitted he purchased from a man from Tanna earlier that day.
- The accused has no previous convictions. Given the quantity of cannabis involved and the early plea of guilty, the case can be appropriately
disposed of with a community based sentence. Both Ms Harrison and Mr Molbaleh accept that a sentence of community work is all that
is required here.
- Effie Nqwero, you are sentenced to carry out 80 hours community work. You are to report to the Court office at 3.00pm today for service
of the order.
- You have 14 days to appeal this sentence if you do not accept it.
