Public Prosecutor v Nqwero [2012] VUSC 152; Criminal Case 89 of 2012 (7 August 2012)

IN THE SUPREME COURT
OF THE REPUBLIC OF VANUATU
(Criminal Jurisdiction)

Criminal Case No. 89/ 2012

PUBLIC PROSECUTOR

V

EFFIE NQWERO

Hearing: 7 August 2012

Before: Justice Robert Spear

Appearances: Tabisa Harrison for the Public Prosecutor
Eric Molbaleh for the Defendant

CONVICTION AND SENTENCE

  1. The defendant has been arraigned today and he has pleaded guilty to one charge of possessing cannabis.
  2. He was found by the Police with total of 18.1 grams of cannabis that he admitted he purchased from a man from Tanna earlier that day.
  3. The accused has no previous convictions. Given the quantity of cannabis involved and the early plea of guilty, the case can be appropriately disposed of with a community based sentence. Both Ms Harrison and Mr Molbaleh accept that a sentence of community work is all that is required here.
  4. Effie Nqwero, you are sentenced to carry out 80 hours community work. You are to report to the Court office at 3.00pm today for service of the order.
  5. You have 14 days to appeal this sentence if you do not accept it.
