IN THE SUPREME COURT OF
THE REPUBLIC OF VANUATU
(Civil Jurisdiction)
Civil Case No: 37 of 2004
BETWEEN:
NIKENIKE VUROBARAVU
Claimant
AND:
THOMAS TENTEN
First Defendant
AND:
BOEDOVO TRUST
Second Defendant
Coram: Mr Justice Oliver A. Saksak
Mrs Anita Vinabit - Clerk
Counsel: Mr Richard Kalses for the Claimant.
Mr Willie Kapalu for the Defendants.
Date: Thursday 10th March 2005.
ORDER
The Claimant having abandoned his application dated 18th February 2005 on the basis that the hearing scheduled for 22nd February 2005 in the Lands Tribunal was not held,
And the Defendants having shown that they have paid royalties into a Trust Account held by the Court in compliance with Orders of 16th December 2004, so that there is no longer any basis for a contempt of court charge against the First Defendant,
And the First Defendant having sought orders for costs limited to transport costs from and back to Malo by boat and truck,
And in view of the fact that the Claimant has on 16th December 2004 undertaken to pay any costs ordered by the court as a consequence of the court orders of 16th December 2004,
NOW therefore I Order that -
(1) The Claimant pays the First Defendant’s costs of transport fixed at VT12,000.
(2) The matter will stand adjourned until further notice issued by the Registry.
DATED at Luganville this 10th day of March 2005.
BY THE COURT
OLIVER A. SAKSAK
Judge
