JUDGMENT

p clas class="MsoNormal" style="text-align: justify; margin-top: 1; margin-bottom: 1"> This was an application by Garry Blake for the applicant to restore the name of t of the company back on the Register. The Court on 3rd August 2001 seeks from the counsel to inform the Court who made the order of striking out of the name of the company from the Register. On this requirement, a letter of the 3rd August 2001 by counsel confirmed that the company’s name was strike out from the Register of Companies by the Registrar of the International Company and now applied to be restored. Further, the letter of 18th July, 2001 from the Vanuatu Financial Services Commission who have authority over their type of cause confirmed that the company has complied with the laws governing the status of the company in this jurisdiction.

With view of the iation before me, as the company is an international cnal company, therefore, I accept that the company was struck off the register pursuant to the powers under Section 106 of the International Companies Act and seeks to be restored pursuant to the power under Section 107. Pursuant to Section 107 the Supreme Court has jurisdiction to grant the company’s name to be restored in the Register and be a company operating in the laws of Vanuatu.

Therefore pursuant to Section 107 I find that the company when it was struck ofck off the register was an International Company and as the company has complied for the requirement of its striking off, it be restored to the register again and grant the order sought.
