JUDGMENT

The accused, Graham TAVIMASOE, pleaded guilty to fraudulently converting $8 (eight dollars) entrusted to him by one LEISALE.

On a Sunday in May, 1971 LEISALE met the accused and told him she wanted to hire a motor car. Accused offered to arrange this, and she gave him $8. Accused left her and later met his employer with whom he went back to the employer's plantation. LEISALE met the accused on two subsequent occasions and demanded her money, but each time the accused had a different explanation. In fact, he had spent the money.

The complainant reported the matter to the police after which the accused gave $8 to her.

The Public Prosecutor told the Court that the accused, who is a bachelor earning about $50 a month, was convicted for larceny on the 17th July, 1970 and fined $20.

Mr. GRAY, acting as Native Advocate, told the Court that the accused met his employer after getting the money and was taken home by him. He said it was not unusual for a New Hebridean having got money from another, not to return it. He asked the Court to be as lenient as possible.

The Court finds accused guilty on his plea and imposes a fine of $30, and in default of payment orders imprisonment of fifteen days as provided in Article 14(5) of the Protocol.
