v.

TURTABANG of LELEPPA

The accused in this case was charged on the first count that in the month of August 1962 on the island of Leleppa in Central District No. 1 he had sexual intercourse with JANETH of Leleppa without her consent and on a second count that in the month of August 1962 on the island of Leleppa in Central District No. 1 he did indecently and forcibly assault JANETH of Leleppa, a girl aged 13 years.

At the hearing the complainant, JANETH refused to speak, and as the only other evidence against the accused was a statement made to the Police in which he said "I tru no mor" the Court dismissed the case.
