Public Prosecutor v Scott [2002] VUCA 15; CA 02-02 (26 April 2002)

IN THE COURT OF APPEAL OF
THE REPUBLIC OF VANUATU
(Appellate Jurisdiction)

CRIMINAL APPEAL CASE No. 02 OF 2002

BETWEEN:

PUBLIC PROSECUTOR
Appellant

AND:

MASLEA SCOTT
JEREMAIAH TULA
Respondents

MINUTE OF THE COURT

When this matter was dealt with in the call over on the 22nd of April 2002, it became apparent that the respondents were not aware that the appeal was before the Court. In a case such as this, it is essential that respondents are present in Court and in a position to have their rights fully recognised and protected.

Accordingly this appeal has been adjourned for hearing before the Court of Appeal convened in the Court House at Santo at 9.00AM on Monday on 21st October 2002. It is essential that the authorities ensure that the respondents are advised.

The respondents are further required to make an appearance in the first instance in the Supreme Court at Luganville on Monday 14 October 2002 to assist in ensuring their attendance before the Court of Appeal. A failure to appear on the 14 October will lead to a warrant being issued immediately. If they appear they can be bailed to the 21st October 2002.

DATED at PORT-VILA, this 26th DAY of APRIL, 2002

BY THE COURT

J.B. ROBERTSON J
