SELU VAIATA
v
SULIO NEAU
(Divorce. Skeen C. J. Nuku'alofa 17th February, 1909).
Life imprisonment — No need for decree.
The Petitioner applied for a divorce, presumably on the grounds of adultery. Her husband had been convicted of incest and sentenced to imprisonment for life.
SKEEN C. J. pointed out that there was no need for a decree in divorce because Section 655 (1903 Laws) provided that a person sentenced to imprisonment for life is considered dead by the law and the wife (or husband) of such person "shall be free to marry again".
