JUDGMENT
- Petitioner and Respondent got married on 16/11/2000. There are no issues or children to the said marriage. Petitioner filed for
divorce on 2nd May 2017. Petitioner filed for divorce on the grounds of adultery and separation.
- Matter has been mentioned three times, the third time being today. Matter also mentioned previously on 4/7/2017 and 1/8/2017.
- Today’s motion, both parties were represented by their respective legal practitioners. Counsel for the Respondent submitted
and conceded to the main relief of dissolution of this marriage on the ground of adultery. Respondent also conceded to the other
reliefs; Petitioner sought for Respondent to have ownership of two Henderson properties (PN 192-004-409 and PN 192-004-418). Respondent
however opposed the relief for cost sought by Petitioner.
- Counsel for the Petitioner in oral submissions assented to the submissions by counsel for the Respondent. What all these means is
that the petition for divorce on the ground of adultery is not contested.
- Accordingly, Court orders that:-
- 5.1. Decree absolute dissolving this marriage is granted on the ground of adultery.
- 5.2. Respondent to have ownership of two Henderson properties.
- 5.3. No order on cost.
