An Act
entitled
Teaching Service (Amendment) Act 2014,
Being an Act to amend the Teaching Service Act 1988,
MADE by the National Parliament to come into operation in accordance with a notice in the National Gazette by the Head of State, acting with, and in accordance with, the advice of the Minister.
1. DEALING WITH MINOR OFFENCES (AMENDMENT OF SECTION 84).
Section 84 of the Principal Act is amended by inserting a new subsection after Subsection (1A) as follows:
"(1B) If the Chief Executive Officer of a District Development Authority has reason to believe that a member of the Teaching Service employed in the district has committed a disciplinary offence that, in the opinion of the Chief Executive Officer, would be properly dealt with under this section, he may charge the member with the offence in the prescribed manner.".
2. DEALING WITH SERIOUS OFFENCES (AMENDMENT OF SECTION 85).
Section 85 of the Principal Act is amended by inserting a new subsection after Subsection (1A) as follows:
"(1B) If the Chief Executive Officer of a District Development Authority has reason to believe that a member of the Teaching Service employed in the district has committed a disciplinary offence that, in the opinion of the Chief Executive Officer, would be properly dealt with under Section 84, he may charge the member with the offence in the prescribed manner.".
3. SUSPENSION (AMENDMENT OF SECTION 90).
Section 90 of the Principal Act is amended by repealing Subsection (1) and replacing it with the following:
"(1) If it is considered that an alleged disciplinary offence is of such a nature that the member of the Teaching Service concerned should not continue in the performance of his duty, the member may be suspended from duty by -
(a) the Commission; or
(b) a person authorised by the Commission for the purpose; or
(c) in the case of an emergency, any person authorised to lay charges under this Part; or
(d) the Chief Executive Officer of the District Development Authority for the district in which the member is employed.".
