AN ACT

entitled

Prices Regulation (P'nyang LNG Project) (Amendment) Act 2022,

Being an Act to amend the Prices Regulation Act (Chapter 320),

MADE by the National Parliament.

1. INTERPRETATION (AMENDMENT OF SECTION 1).

Section 1 of the Principal Act is amended in Subsection (1) by inserting immediately after the definition "PNG LNG Gas Agreement" the following new definitions in alphabetical order:

""P'nyang LNG Project Gas Agreement" means the P'nyang LNG Project Gas Agreement dated 22 February 2022 between the Independent State of Papua New Guinea, Esso PNG P'nyang Limited, Ampolex (Papua New Guinea) Limited, Oil Search Limited, Oil Search (PNG) Limited and Merlin Petroleum Company, as amended, novated or replaced from time to time;
"P'nyang LNG Project Petroleum" has the meaning given to Project Petroleum in the P'nyang LNG Project Gas Agreement;
"P'nyang LNG Project Services" has the meaning given to Project Operations in the P'nyang LNG Project Gas Agreement.".

2. DECLARED GOODS AND SERVICES (AMENDMENT OF SECTION 10).

The Principal Act is amended in Section 10 by inserting immediately after Subsection (5) the following new subsection:

"(6) Notwithstanding any contrary provision of this Act, for the purposes of this Act, P'nyang LNG Project Petroleum is not, and cannot be, declared goods and P'nyang LNG Project Services are not, and cannot be, declared services.".
