PRIME MINISTER AND NATIONAL EXECUTIVE COUNCIL (AMENDMENT) ACT 2020

ARRANGEMENT OF SECTIONS.

1. Departmental Head of the Department of Prime Minister and National Executive Council (Repeal and replacement of Section 17).
2. Chief Secretary to Government (Amendment of Section 19).

AN ACT

entitled

Prime Minister and National Executive Council (Amendment) Act 2020.

Being an Act to amend the Prime Minister and National Executive Council Act 2002 and for related purposes,

MADE by the National Parliament, to be deemed to have come into operation on 12th February, 2020.

1. DEPARTMENTAL HEAD OF THE DEPARTMENT OF PRIME MINISTER AND NATIONAL EXECUTIVE COUNCIL (REPEAL AND REPLACEMENT OF SECTION 17).

Section 17 of the Principal Act is repealed and replaced with the following:

"17. DEPARTMENTAL HEAD OF THE DEPARTMENT OF PRIME MINISTER AND NATIONAL EXECUTIVE COUNCIL.
(1) The Chief Secretary to Government is the Departmental Head of the Department of Prime Minister and National Executive Council.
(2) Subject to Subsection (3), where the Office of the Chief Secretary to Government is vacant on the grounds of expiry of term of office, the person holding the position of Chief Secretary to Government, immediately before the vacancy arises, continues to hold office for up to three months, or until a substantive appointment is made.
(3) Notwithstanding Subsection (2), the Head of State, acting with, and in accordance with the advice of the National Executive Council may appoint another person, who is qualified to hold office as a departmental head, to act as Departmental Head of the Department of Prime Minister and National Executive Council.".

2. CHIEF SECRETARY TO GOVERNMENT (AMENDMENT OF SECTION 19).

Section 19 of the Principal Act is amended -

(a) in Subsection (2), by deleting the word "substantive"; and
(b) by repealing Subsection (3).
