AN ACT

entitled

Mutual Assistance in Criminal Matters (Amendment) Act 2015,

Being an Act to amend the Mutual Assistance in Criminal Matters Act 2005, and for related purposes,

MADE by the National Parliament to come into operation in accordance with a notice in the National Gazette by the Head of State, acting with, and in accordance with, the advice of the Minister.

1. DEFINITIONS (AMENDMENT OF SECTION 3).

Section 3 of the Principal Act, is amended in Subsection (2) by inserting after Paragraph (b) the following new paragraphs:

"(ba) instrument; and

(bb) interim restraining order; and".

2. AMENDMENT TO THE HEADING OF PART VII. - ASSISTANCE REGARDING PROCEEDS OF CRIME.

The heading to Part VII is repealed and replaced with the following new heading:

"PART VII. ASSISTANCE REGARDING PROCEEDS AND INSTRUMENTS OF OFFENCES.".

3. NEW DIVISION 1A.

The Principal Act is amended in Part VII before Division 1, by inserting the following new division:

"Division 1A. - Application of Part.

39AA. APPLICATION OF PART.

This Part applies to proceeds and instruments of offences, including property of corresponding value, and property that may be used to satisfy a foreign pecuniary penalty order.".

4. REQUESTS FOR RESTRAINING ORDERS (AMENDMENT OF SECTION 48).

Section 48 of the Principal Act is amended -

(a) in the heading of the section by deleting "RESTRAINING" and replacing it with "INTERIM RESTRAINING"; and

(b) in Paragraph (a) by deleting "criminal" (twice occurring); and

(c) in Paragraph (c) by deleting "a restraining" and replacing with "an interim restraining"; and

(d) by deleting "a restraining" appearing in the paragraph after Paragraph (c) and substituting "an interim restraining".

5. AMENDMENT TO THE HEADING OF PART I.

The Principal Act, is amended in the heading of Part I by repealing "PART 1" and replacing it with "PART I".
