14B. FILLING OF VACANCIES.".

An Act

entitled

Local-Level Governments Administration (Amendment) Act 2022.

Being an Act to amend the Local-Level Governments Administration Act 1997,

MADE by the National Parliament to come into operation in accordance with a notice in the National Gazette by the Head of State, acting with, and in accordance with, the advice of the Minister.

NEW SECTIONS 14A AND 14B.

The Principal Act is amended by inserting immediately after Section 14, the following new sections:

"14A. QUALIFICATIONS FOR AND DISQUALIFICATIONS FROM MEMBERSHIP.
(1) A member must be not less than 25 years of age.
(2) A candidate for membership must have been born in the area of the Local-Level Government for which he intends to nominate or have resided in the area for a continuous period of two years immediately preceding his nomination or for a period of five years at any time and must pay a nomination fee of K200.00.
(3) A person ceases to be, or to remain, a member if -

• (a) he is not entitled to vote in elections; or
• (b) he nominates to contest the National General Elections; or
• (c) he is otherwise disqualified under this Act.

14B. FILLING OF VACANCIES.
(1) Where a vacancy has arisen in the office of a member for any reason, the vacancy shall be filled -

• (a) in respect of the Head of the Local Level Government, accordance with Section 12(1)(b); and
• (b) in respect of other members, in accordance with the Standing Orders.

(2) Notwithstanding Subsection (1), a vacancy may be filled under the provisions of the Organic Law on National and Local-Level Government Elections in accordance with a determination made under Section 234(2) of the Organic Law on National and Local-Level Elections.".
