AN ACT
entitled
Gaming Machine (Amendment) Act 1995,
Being an Act to amend the Gaming Machine Act 1993,
MADE by the National Parliament.
Section 2 of the Principal Act is amended -
(a) by repealing the definition of "manufacture"; and
(b) in the definition of " 'permit holder' or 'holder of a permit' ", by repealing the words 'bottle shop" and replacing them with the following:-
- "restaurant"; and
(c) in the definition of "site", by repealing the words "bottle shop" and replacing them with the following:-
- "restaurant"; and
(d) in the definition of "site owner", by repealing the words "bottle shop" and replacing them with the following:-
- "restaurant".
Section 3(4) of the Principal Act is repealed.
Section 6 of the Principal Act is amended -
(a) in Subsection (1) -
- (i) by repealing Paragraph (b) and replacing it with the following:-
- "(b) one member nominated by the Papua New Guinea Council of Churches;"; and
- (ii) by repealing Paragraph (c) and replacing it with the following:-
- "(c) one member representing the industry appointed by the Minister;"; and
(b) in Subsection (2)(b), by repealing the words "five years" and replacing them with the following:-
- "three years".
Section 18(2) of the Principal Act is amended -
(a) in Paragraph (a), by repealing the words "the Board" and replacing them with the following:-
- "the Minister"; and
(b) in Paragraph (b), by repealing the words "four years" and replacing them with the following:-
- "three years"; and
(c) in Paragraph (d), by repealing with words "the Board" and replacing them with the following:-
- "the Minister".
Section 20 of the Principal Act is repealed and is replaced with the following:-
"20. STAFF.
The Registrar may, with the consent of the Board, employ such other persons as are necessary but subject to a staff ceiling approved by the Department responsible for personnel management matters.".
Section 34(1)(a) of the Principal Act is repealed.
Section 44(2)(e) of the Principal Act is repealed.
Section 53(1) (c) of the Principal Act is amended by repealing the words "or any variations or renewals thereof".
Section 65 of the Principal Act is repealed -
(a) in the definition of "cancelled credits payment", by repealing the words in parenthesis "(otherwise than directly, from the gaming machine)"; and
(b) by repealing the definition of "payouts" and replacing it with the following:-
- " 'payouts' means cancelled credit payments and jackpot payments;"; and
(c) by repealing the definition of "refill"; and
(d) by repealing the definition of "revenue" and replacing it with the following:-
- "'revenue' from a gaming machine means money invested by players of a machine in order to play a machine;"; and
(e) by repealing the definition of "short pay".
Section 67 of the Principal Act is amended -
(a) in Subsection (1), by repealing the percentage "60%" and replacing it with the following;-
- "100%"; and
(b) in Subsection (2) -
- (i) in Paragraph (b), by repealing the words "opened and operated by and in the name" and replacing them with the following:-
- "opened and operated by the Board and in the name"; and
- (ii) by repealing Paragraph (c) and replacing it with the following:-
- "(c) 5% to a trust account for the purpose opened by the Board on behalf of the Department responsible for finance and planning matters;".
Section 69 of the Principal Act is amended in the definition of "relevant matter" by repealing the word "manufacture".
Section 72(2) of the Principal Act is amended by repealing the words "together with any money that was in it" and "money".
Section 79(2) of the Principal Act is amended by repealing the words "a coin of the Independent State of Papua New Guinea or other object" and replacing them with the following:-
"an object".
