FACTS
A warrant of arrest was issued against the defendant on 12 November 2015 in respect of the defendant not complying with the Bugaoljim Village Court Order No 209409 dated 2 April 2015. He was given two orders by the village court where he was given until 30th July to pay K1885 to the complainants and the K20.00 court fine.


ISSUE

Whether to continue the case.
FINDINGS

  1. The complainant has failed to show cause on why this case should continue.
  2. Case prolonged matter from 2016
  3. Warrant of arrest not revoked.

The court finds that the complainant has failed to progress this file. There is no need for this matter to remain in this court.
COURT ORDER

I therefore make the following orders:

  1. Case is dismissed. Case is prolonged and inactive.
  2. Warrant of Arrest Revoked.
  3. Cost be in the cause.
