Enacted by the Parliament of Nauru as follows:
1 Short title
This Act may be cited as the Passports (Amendment) Act 2020.
2 Commencement
This Act commences on certification of the Speaker.
3 Amendment of the Passports Act 2011
The Passports Act 2011 is amended by the provisions of this Act.
4 Amendment of Section 3
(a) in subsection (1), by deleting the term ‘Head of Department’ and its definition; and
(b) by inserting in alphabetical order the following terms and their definitions:
- (i) ‘Minister’ means the Minister for Justice and Border Control; and
- (ii) ‘Secretary’ means the Secretary for Justice and Border Control.
5 Amendment of Section 56
Section 56 is deleted and substituted as follows:
‘56 Register of travel documents
(1) The Secretary shall keep and maintain a separate register each of:
- (a) Presidential passport;
- (b) diplomatic passports;
- (c) official passports;
- (d) Nauruan ordinary passports;
- (e) travel-related documents;
- (f) refugee travel documents; and
- (g) certificates of identity.
(2) The registers shall include the date of issue and expiry of each travel document issued and such other matters as may be prescribed.
(3) The records kept and maintained under this Section shall:
- (a) be contained in digital or electronic form; and
- (b) not be destroyed without the prior approval of the Cabinet.’
6 General amendment as to reference
In this Act, ‘Head of Department’ is deleted wherever it appears and substituted with ‘Secretary’.
