THE TERRITORY OF NAURU
No. 25 of 1967
AN ORDINANCE
To revise, amend and repeal certain Ordinances of the Territory
Be it ordained by the Legislative Council for the Territory of Nauru, in pursuance of the powers conferred by the Nauru Act 1965, as follows: -
(Assented to: 29 December 1967.)
Short title.
1. This Ordinance maybe cited as the Ordinance Revision Ordinance 1967.
Commencement.
2. This Ordinance shall come into operation on a date to be fixed by the Administrator by notice in the Gazette.
General amendment of Ordinances.
3. The Ordinances specified in the first column of the First Schedule to this Ordinance are amended as respectively specified in the second column of that Schedule.
Amendments in relation to decimal currency.
4. The Ordinances specified in the Second Schedule to this Ordinance amended as set out in that Schedule.
Re-numbering.
5. (1) A section of an Ordinance specified in the first column of the Third Schedule to this Ordinance the number of which is specified in relation to that Ordinance in a column headed "Existing section number" in that Schedule is re-numbered as specified opposite to that number in the next succeeding column headed "New section number" in that Schedule.
(2) A reference in a law of the Territory (other than a reference in the First, Second or Fourth Schedule to this Ordinance) or in an instrument or document to a section of an Ordinance specified in the first column of the Third Schedule to this Ordinance shall, if that section has been re-numbered in pursuance of this section, be read as a reference to that section as so re-numbered.
Amendments consequential on re-numbering.
6. The Ordinances specified in the first column of the Fourth Schedule to this Ordinance are amended as respectively specified in the second column of that Schedule.
Repeal.
7. The Ordinances specified in the Fifth Schedule to this Ordinance are repealed.
Amendment of Census Ordinance 1966.
8. (1) The Census Ordinance 1966 is amended -
(a) by omitting from the title the words "Census Ordinance 1961" and inserting in their stead the words "Census Ordinance 1961 as amended by the Executive Council Ordinance 1966"; and
(b) by omitting from section 1 sub-sections (2) and (3) and inserting in their stead the following sub-sections: -
"(2) The Census Ordinance 1961 as amended by the Executive Council Ordinance 1966 is in this Ordinance referred to as the Principal Ordinance.
"(3) The Executive Council Ordinance 1966 is amended by omitting from the Second Schedule thereto the words -
Census Ordinance 1961-1966" |
"(4) The Principal Ordinance, as amended by this Ordinance, may be cited as the Census Ordinance 1961-1966."
(2) The amendment effected by this section shall be deemed to have come into operation on the date on which the Census Ordinance 1966 came into operation.
Amendment of Public Service Ordinance 1966.
9. (1) Section 1 of the Public Service Ordinance 1966 is amended by omitting sub-section (2) and inserting in its stead the following sub-section: -
"(2) The Public Service Ordinance 1961-1965 is in this Ordinance referred to as the Principal Ordinance.".
(2) The amendment effected by this section shall be deemed to have come into operation on the date on which the Public Service Ordinance 1966 came into operation.
Amendment of Social Services Ordinance 1966.
10. (1) Section l of the Social Services Ordinance 1966 is amended by omitting sub-section (2) and inserting in its stead the following sub-section: -
"(2) The Social Services Ordinance 1956-1965 is in this Ordinance referred to as the Principal Ordinance."
(2) The amendment effected by this section shall be deemed to have come into operation on the date on which the Social Services Ordinance 1966 came into operation.
Amendment of Arms and Opium Prohibition Ordinance 1967.
11. Section 1 of the Arms and Opium Prohibition Ordinance 1967 is amended by omitting sub-section (3).
Amendment of Executive Council Ordinance 1967.
12. Section 1 of the Executive Council Ordinance 1967 is amended by omitting sub-section (3).
Amendment of Interpretation Ordinance 1967.
13. Section 1 of the Interpretation Ordinance 1967 is amended by omitting sub-section (2).
Amendment of Licences Ordinance 1967.
14. Section 1 of the Licences Ordinance 1967 is amended by omitting sub-section (3).
Amendment of Motor Traffic Ordinance (No. 2) 1967.
15. Section 1 of the Motor Traffic Ordinance (No. 2) 1967 is amended by omitting sub-section (3).
Amendment of Nauru Local Government Council Ordinance 1967.
16. Section 1 of the Nauru Local Government Council Ordinance 1967 is amended by omitting sub-section (3).
Amendment of Public Health Ordinance 1967
17. Section 1 of the Public Health Ordinance 1967 is amended by omitting sub-section (3).
Amendment of Workers (Contracts of Service) Ordinance (No. 2) 1967.
18. Section 1 of the Workers (Contracts of Service) Ordinance (No. 2) is amended by omitting sub-section (4).
Commencement of Ordinances.
19. (1) An Ordinance specified in the Sixth Schedule to this Ordinance shall, by force of this Ordinance, be deemed to have come into operation on the date on which the Ordinance was signed by the Administrator.
(2) The date on which an Ordinance specified in the Sixth Schedule to this Ordinance was signed, by the Administrator shall, for all purposes, be deemed to be, and at all, times to have been, the date specified in the second column of that Schedule opposite to the citation of that Ordinance in the first column of that Schedule.
(3) An Ordinance specified in the Seventh Schedule to this Ordinance shall, by force of this Ordinance, be deemed to have come into operation on the date specified in the second column of chat Schedule opposite to the citation of the Ordinance in the first column of that Schedule.
(4) The preceding sub-sections of this section do not -
(a) affect the previous operation of an Ordinance specified in the Sixth Schedule or the Seventh Schedule to this Ordinance or anything duly done of suffered under such Ordinance;
(b) affect any right privilege, obligation or, liability acquired, accrued or incurred, under, such an Ordinance;
(c) affect any penalty, forfeiture, or punishment incurred in respect of any offence committed against such an Ordinance; or,
(d) affect any investigation, legal proceeding or remedy in respect of any such right, privilege, obligation, liability, penalty, forfeiture or punishment,
and any such investigation, legal proceeding or remedy may be instituted, continued or enforced, and any such penalty, forfeiture or punishment may be imposed, as if this section had not been included in this Ordinance.
Citation of amended Ordinances.
20. Each Ordinance specified in the first column of the English Schedule to this Ordinance, as amended by this Ordinance, may be cited in the manner specified in the second column of that Schedule opposite to the reference to that Ordinance in the first column.
