REPUBLIC OF NAURU
NAURU LOCAL GOVERNMENT COUNCIL ORDINANCE AMENDMENT ACT 1985
(No. 6 of 1985)
AN ACT
To Amend the Nauru Local Government Council Ordinance 1951-1967.

Enacted by the Parliament of Nauru as follows:-
SHORT TITLE
1. (1) This Act may be cited as the Nauru Local Government Council Ordinance Amendment Act 1985.
(2) The Principal Ordinance amended by this Act may be cited as the Nauru Local Government Council Act 1951-1985.
INTERPRETATION
2. In this Act, 'Principal Ordinance' means The Nauru Local Government Council Ordinance 1951-1967.
AMENDMENT OF SECTION 32 OF THE PRINCIPAL ORDINANCE
3. Section 32 of the Principal Ordinance is amended by the addition of the following new sub-section (1-A) thereto:-
"(1-A) Notwithstanding the provisions of sub-section (1)(f), when on a final count between two candidates, they have an equal number of votes, the process of exclusion provided in the last preceding sub-section (1)(h) shall be used by the Returning Officer and the candidate chosen by lot shall thereupon be excluded and deemed defeated and the other candidate declared elected."
