An Act to amend the Civil Aviation Act 2011.

Enacted by the Parliament of Nauru as follows:

1 Short title

This Act may be cited as the Civil Aviation (Amendment) Act 2021.

2 Commencement

This Act commences on certification of the Speaker.

3 Amendment of the Civil Aviation Act 2011

The Civil Aviation Act 2011 is amended by the provisions of this Act.

4 Amendment of Section 6

Section 6 of the Act is amended by inserting the following terms and their definitions, in alphabetical order:

‘(a) ‘Minister’ means the Minister for Transport or any other Minister responsible for this Act;

(b) ‘Secretary’ means the Secretary for Transport or any other head of department administering this Act;’

5 Amendment of Section 73

Section 73(2)(d) is amended by deleting the word ‘Cabinet’ where it appears and substituting with the words ‘the Minister’.

The clause now reads:

‘(d) an aircraft authorised to do so by the Minister, unless the Minister is of the opinion that such authorisation shall be given by the Cabinet.’
