Akibwib v Chief Secretary [2009] NRSC 16; Public Service Appeal Case No 1 of 2009 (7 August 2009)

IN THE SUPREME COURT OF NAURU

PUBLIC SERVICE APPEAL CASE NO.1 /2009

BETWEEN

ERICA AKIBWIB & others
Appellants

AND

THE CHIEF SECRETARY
Respondent

Mr. Robert Kaierua for the Respondent
Mr. Vinci Clodumar for the Appellants

7 August, 2009.

DECISION OF THE PUBLIC SERVICE APPEALS BOARD

Mr. Kaierua for the Chief Secretary acknowledges that none of these ladies was given any warning before being dismissed.

Fairness required that each should have been given a warning and an opportunity to improve her work performance. If there were no improvement, dismissal would be justified.

In our view dismissal without warning was inappropriate and is sufficient for the Board to allow the appeals.

Appeals allowed.
