ORDER

HAVING heard Ms Beiatau of Counsel for the respondent, I feel the appeal should be struck out.

One of the conditions of bail pending appeal is that the appellant should attend the High Court sitting in Kiritimati Island to have his appeal dealt with. The appellant did not turn up.

The appeal is struck out.

The appellant is hereby ordered to serve his sentence in prison as imposed by the Magistrates’ Court.
