ORDER


Zehurikize J: Since Counsel for the Respondent does not oppose the appeal and it appears there were some irregularities in dismissing the case, the appeal is allowed. The order dismissing the case is set aside. The trial court is directed to hear the case on merit expeditiously. The trial court to fix a hearing date as soon as possible.
