IN THE HIGH COURT OF KIRIBATI
Criminal Jurisdiction
Held at Betio
Republic of Kiribati
High Court Criminal Case No. 22 of 2006
THE REPUBLIC
v
IOANE ITINTARAWA
For the Republic: Ms Ruria Iteraera
For the Accused: Ms Botika Maitinnara
Date of Hearing: 12 May 2006
SENTENCE
Ioane Itintarawa: you have pleaded guilty to house-breaking, an offence which has a penalty of 14 years’ imprisonment.
About 11 pm last 30 January at Antebuka you went into the office of the KPC by taking out the louvers from a window and stole a number of things. You had turned on the light and drawn the curtains. Maribo noticed the light was on and disturbed you. Maribo recognized you and chased you but you got away. You buried everything in a plastic bag: a week later you shewed the police where it all was. Only a small radio was not recovered.
You have no previous convictions and pleaded guilty on your first arraignment. You will receive a lesser penalty than you otherwise would have because you have no previous convictions, pleaded guilty and most of the things were returned.
You are 18 and live with your parents and have a partner. You are the only boy in the family. You are not employed but you go fishing and cut toddy. You had been drinking sour toddy on this night, saw the KPC office was open and this tempted you to go in.
All crimes are serious but this is less serious than others. You must learn though not to do things like this again or you will spoil your future life.
You will be imprisoned for four months but the sentence will be suspended if you promise to behave yourself in the next 12 months and not to commit any more offences.
If you do not commit any other crimes in the next year then you will not have to spend this four months in prison.
If you do commit any other crime in the next year then you will be punished for it and also be liable to serve this four months in gaol as well.
Ko ota? Yes.
Ko tuea? Yes.
Dated the 17th day of May 2006
THE HON ROBIN MILLHOUSE QC
Chief Justice
