SENTENCE


Ataake Tekanene: you have been found guilty of assault occasioning actual bodily harm. The facts are in my reasons for judgment. I shall not repeat them except to say that it was a mistake on your part. You assaulted the victim in the belief that the victim had attacked your son: in fact another young man had attacked your son.


You have no previous convictions and have a responsible position in the community. This was not one of the most serious assaults – although any assault is a serious matter.


The appropriate penalty is a fine. You are fined $75.00.
