JUDGMENT

This is a purported appeal against South Tarawa Magistrates Lands Court in case BA 8/89. The Magistrates seemed to have left the case incomplete in that they did not make a final decision. The case was adjourned without giving a date to which they had adjourned and it appears that it was never resumed again.

In the circumstances now prevailing that some of those Magistrates are no longer available and there have been considerable delay in finalising this case we think the proper course would be that the Magistrates should re-hear this case afresh.

We remit this case back to the Magistrates with that direction.
