PREVENTION OF BRIBERY (FORMS) REGULATIONS 2007

IN exercise of the powers conferred upon me by section 34 of the Prevention of Bribery Promulgation 2007, I make these Regulations-

Citation

1. These Regulations may be cited as the Prevention of Bribery (Forms) Regulations 2007.

Forms

2. The forms set out in the Schedule are prescribed for use in connection with the Prevention of Bribery Promulgation 2007.

PREVENTION OF BRIBERY PROMULGATION

FORM 1

EX PARTE APPLICATION FOR THE ISSUE OF A SEARCH WARRANT
(Section 17(1))

In the Magistrates' Court at.......................................Fiji.

APPLICATION

Made by (name and description of applicant) of (address of applicant), an investigating officer for the purposes of the Prevention of Bribery Promulgation (the Promulgation),

Who states that he believes that in (description of premises or place) at (address of premises or place) of (name of owner, occupier or person in charge of premises or place, if known) ("the specified premises or place") there are (description of things) which are or which contain evidence of (description of offence), being an offence under the Promulgation,

For an order under section 17(1A) of the Promulgation for a warrant directed to (name and description of investigating officer to be authorised) of (address of investigating officer to be authorised), an investigating officer for the purposes of the Promulgation, empowering him and (particulars of any other investigating officer for the purposes of the Promulgation to be authorised) to enter the specified premises or place, by force if necessary, and search the same.

SEARCH WARRANT

WHEREAS on an application made to me this day by (name and description of applicant) of (address of applicant) an investigating officer for the purposes of the Prevention of Bribery Promulgation (the Promulgation),

I am satisfied that there is reasonable cause to believe that in (description of premises or place) at (address of premises or place) of (name of owner, occupier or person in charge of premises or place, if known) ("the specified premises or place") there are (description of things) which are or which contain evidence of (description of offence), being an offence under the Promulgation,

I HEREBY BY WARRANT empower (name and description of investigating officer to be authorised) of (address of investigating officer to be authorised), an investigating officer for the purposes of the Promulgation, and (particulars of any other investigating of officer for the purposes of the Promulgation to be authorised) to enter the specified premises or place, by force if necessary, and search the same.
