AN ACT
TO AMEND THE MARINE ACT, 1986
ENACTED by the Parliament of Fiji-
Short title
1. This Act may be cited as the Marine (Amendment) Act, 1998.
Amendment of Marine Act 1986
2. The Marine Act, 1986 is amended-
(a) in section 2 by inserting after the definition of "special coasting trade licence" the following new definition-
" "STCW Convention" means the International Convention on Standards of Certification, Training and Watchkeeping for Seafarers 1978, including the Code, as amended in 1995, and as affected by any further amendment binding on the State;";
(b) by inserting after section 143 the following new section-
"STCW Convention
143A.-(1) Subject to this Act, the STCW Convention has the force of law as part of the law of the Fiji Islands.
(2) Regulations may make provision for, or in relation to the implementation of, or giving effect to the STCW Convention.
(3) A vessel that is at a port or place or at sea without the number and grade of seamen required by the STCW Convention or prescribed by regulations made under subsection (2) is not properly manned and the provisions of this Act relating to such vessels apply accordingly.".
Passed by the House of Representatives this Fifteenth day of May, in year of our Lord One Thousand, Nine Hundred and Ninety-Eight.
