Bici v Reginam [1982] FJSC 54; Criminal Appeal 25 of 1982 (30 April 1982)

IN THE SUPREME COURT OF FIJI
Appellate Jurisdiction

Criminal Appeal No. 25 of 1982

BETWEEN:

TAITUSI BICI

AND:

REGINAM

Mr. R. Chand for the Appellant
Mr. J. Subhrawal with Mr. E. Tavaiqia for the Respondent

JUDGMENT

In view of all the circumstances which have emerged at the hearing of the appeal in this case and particularly in view of the fact that appellant had replaced another bull to the ownership of complainant and the fact that complainant had wholly forgiven appellant and the appellant has already served 2 ½ months in prison, I am satisfied that the ends of justice will be met in this case if I substituted the sentence of eighteen months passed on appellant at the Nausori Magistrate's Court to one that would allow his release from gaol today.

I order accordingly.

(T. U. Tuivaga)
Chief Justice

Suva,
30th April, 1982.
