DECISION
(Summary Dismissal)
[1] The Petitioner, Richard Kashmir Kumar, is a serving prisoner. He has filed an Application for Constitutional Redress using Form HCCR 1.
[2] The Petitioner’s application for constitutional redress is vague and lacks details. His claim for relief in the Form reads:
4. State what remedy you seek from the Court? Give details of what you ask, the nature of the claim for:
(a) a declaration I am seeking a resentencing by the Government of the Day.
[3] The Petitioner has not presented any genuine claim for constitutional redress. His application is frivolous, vexatious and an abuse of the court process.
[4] The application is summarily dismissed pursuant to the inherent jurisdiction of this Court (see, Tokoniyaroi v Commissioner of Police [2023] FJSC 24; CBV0017.2019 (30 June 2023)).
[5] An application for constitutional redress made in person by the Petitioner in the future is not to be accepted without the sanction of a judge of the High Court.
