under the Succession, Probate and Administration Act (Cap 60)..

ORDER OF THE COURT


As per my Order in HBC 144 of 2007 and in terms of Practice Direction No. 2 of 1992 and especially as this matter is concerning minors, and if such applications are permitted outside Suva principal probate court, the minors when they are adults will not be able to find out on how their inheritance had been administered and dealt with, as by different motions at different times, different properties could be sold, without being visible in one proceedings.


  1. As such, I transfer this case to the Suva Principal Probate Registry and Suva High Court with probate jurisdiction to hear this application and make suitable order;
  2. As such I hereby order that this matter be amalgamated to proceedings in which letter of Administration No 46606 issued in Suva Probate Registry and;
  3. Mention this matter for support by Mr Haroon Ali Shah in Suva High Court Probate Registry on 11 August 2010 as such date is a date convenient for counsel for applicant to be present in Suva.

The Acting Deputy Registrar Lautoka High Court is hereby directed to transfer this Motion matter to Suva Probate Registry and High Court as above immediately.
