BAIL RULING

The Applicant applies for bail pending trial. He is charged with the murder of Sarwan Kunar on the 17th of March 2008 at Nadi in the Western Division. The deceased was his father-in-law. His trial has not been allocated a date, but with the current case-management system, is likely to be heard within 9 months. The two judges hearing criminal cases in Lautoka are currently setting trial dates for August and September.

This is not the first bail application made by the Applicant. Indeed bail has been applied for since his first appearance in the Nadi Magistrates' Court on the 20th of March 2008. The grounds were that the Applicant has a right to bail, that he is not a flight risk, and that he has no previous convictions that he will remain
