RULING
This is an application for bail pending appeal. The appeal has been adjourned to 30th July 2001 due to the fact that the Appellant said his counsel was unavailable. It now transpires that he has not instructed counsel and the appeal could have been heard at 9.30 a.m. as designated.
However after considering the evidence of Captain Veer Chand of the Salvation Army and his submissions, and having heard counsel for the State, I am satisfied that this is not one of the exceptional cases where bail pending appeal should be granted.
The Appellant has only a few days to the hearing of the appeal, the sentence is a long one and there does not appear to be an obvious prospect of success. This application is refused.
