DECISION


This is an employment grievance between Mr Jone Vuniyani (the worker) and Beachcomber Island Resort (the Employer) concerning the worker's dismissal on about 19 August 2008.


The Grievance was referred to the Tribunal on 10 November 2008 by the Mediation Unit pursuant to section 194 (5) of the Employment Relations Promulgation 2007 (the Promulgation).


The Grievance was initially listed for mention on 18 November and again on 27 November 2008 due to the non-appearance of the Employer. On 19 December 2008 the Tribunal gave directions for the filing of written submissions and the Grievance was relisted for mention on 2 February 2009.


When the Grievance was called for mention on 16 February 2009, the parties informed the Tribunal that the Grievance had been settled. A letter dated 13 February 2009 and signed by the parties was handed to the Tribunal. That letter set out the terms of the agreed settlement and has been endorsed by the Tribunal in accordance with section 210 (2) of the Promulgation.


A copy of the endorsed terms is attached to this decision.
