DECISION


This is a dispute between Fiji Public Service Association (the Union) and Fiji Institute of Technology (the Employer) concerning the dismissal of Abdul Aleem Khan (the worker).


The dispute was referred to the Tribunal by the Mediation Unit on 21 October 2008 and was initially listed for mention on 29 October 2008.


Following the filing of written submissions the Dispute was listed for hearing on 9 February 2009.


At the request of the parties the matter was called for mention on Thursday 5 February 2009.


As the Dispute raised an issue connected with the Tribunal's jurisdiction and as that issue is currently on appeal before the Employment Court, the Union formally applied for a stay of the commencement of the hearing. The Employer indicated that it consented to the application.


As a result the Tribunal orders by consent that the hearing date be vacated and that the Dispute be listed for mention on 5 March 2009 at 9.00 am. Costs in the cause.
