PURSUANT to Sections 49B and 51 of the Entry, Residence and Departure Act 1971-72, His Excellency the Queen's Representative, acting by and with the advice and consent of the Executive Council, hereby makes the following Regulations:

Schedule

1. Short title and commencement - (1) These Regulations may be cited as the Entry, Residence and Departure Fees (Amendment) Regulations 2008, and shall be read together with and deemed part of the Entry, Residence and Departure Fees Regulations 1976 (hereinafter referred to as "the principal Regulations").

(2) These Regulations shall come into force on the date they are assented to by the Queen’s Representative.

2. Fees payable - The principal Regulations are amended by revoking regulation 3, and substituting the following -

"3 Fees payable - (1) Where a person is required to pay any fee pursuant to these Regulations and that person is legally married to a Cook Islander or Permanent Resident, he or she shall pay the fee payable as set out in Column 1 of the Schedule to these Regulations.

(2) Every other person shall pay the fee as set out in Column 2 of the Schedule to these Regulations.

3. New schedule - The principal Regulations are hereby amended by revoking the Schedule and substituting the Schedule set out in these Regulations.

4. Revocation - The Entry, Residence and Departure Fees (Amendment) Regulations 1997 are hereby revoked.
