An Act to amend the Cook Islands Workers' Compensation Ordinance 1964
(18 April 1974
BE IT ENACTED by the Legislative Assembly of the Cook Islands in Session assembled, and by the authority of the same, as follows:
1. Short Title and commencement - (1) This Act maybe cited as the Workers' Compensation on Ordinance Amendment Act 1973-74 and shall be read together with and deemed part of the Cook Islands Workers' Compensation Ordinance 1964 (hereinafter referred to as "the Ordinance").
(2) This Act shall take effect from the 1st day of January 1974.
2. Interpretation - The Ordinance is hereby amended by inserting after subsection (3) of section 2 the following new subsections-
"(4) It is hereby declared that for the purpose of this Ordinance that-any person in the following classes of occupations are, as such, deemed to be workers employed by the Crown:
(i) the Speaker or a member of the Legislative Assembly;
(ii) a member of the House of Ariki;
(iii) a member of any Island or District Council constituted under the provision of the Local Government Act 1966 or any other Act."
3. Compensation in fatal cases - The proviso subsection (a) of section 6 of the Ordinance is amended by deleting the words "five hundred dollars" and substituting "seven hundred and fifty dollars".
4. Compensation in the case of permanent total incapacity - The proviso in Section 7 of the Ordinance is amended by deleting the words "five hundred dollars" and substituting "seven hundred and fifty dollars".
5. Compensation in the case of temporary incapacity - Subsection (1) of section 9 of the Ordinance is amended by deleting the words in "two-thirds" and substituting "four-fifths".
6. Minister of Financial Services to be charged with administering the Ordinance - The Schedule to the Cook Islands Ordinances Amendment Act 1966 is hereby amended by deleting the "Minister of Labour and Employment" and substituting the "Minister of Financial Services" as the Minister charged with administering the Cook Islands Workers' Compensation Ordinance 1964.
