An Act to amend the Entry, Residence and Departure Act 1971-72

BE IT ENACTED by the Parliament of the Cook Islands in Session assembled, and by the authority of the same as follows:
This Act may be cited as the Entry, Residence and Departure Amendment Act 1995-96 and shall be read together with and deemed part of the Entry, Residence and Departure Act 1971-72 (hereinafter referred to as "the principal Act").
Section 2 of the principal Act is amended, by deleting the definition of "bona fide visitor" and substituting the following new definition -
""Bona fide visitor" means any person who enters the Cook Islands for the purpose of -
- (a) holidaying or recreation; or
- (b) exploring investment opportunities where the Principal Immigration Officer is satisfied that such business will be completed within 21 days."
Section 5 of the principal Act is amended by adding after subsection (1), the following new subsection:
"(1)(a) A Permanent resident shall upon being granted a certificate pursuant to subsection (1) hereof, take and subscribe before the Queen's Representative the declaration contained in the Schedule hereto."
The Schedule to the principal Act is hereby amended by adding after Form 1 and before Form 1A the following declaration:

Declaration by Permanent residents
"I, ........................., do solemnly and sincerely declare, that I will be faithful and bear true allegiance to Her Majesty Queen Elizabeth II as the Head of State of the Cook Islands, Her Heirs and Successors, according to law; that I will faithfully observe the Constitution and other laws of the Cook Islands; that I will always respect the customs, traditions, usages and values of the people of the Cook Islands; that I will conscientiously fulfil my duties as a national of the Cook Islands, and that I take this obligation freely without any mental reservation or purpose of evasion. So help me God."
This Act is administered by the Immigration Department
