An Act to amend the Civil List Act 1968
(16 April 1973
BE IT ENACTED by the Legislative Assembly of the Cook Islands in Session assembled, and by the authority of the same, as follows:
(1) This Act may be cited as the Civil List Amendment Act 1973 and shall be read together with and deemed part of the Civil List Act 1968 (hereinafter referred to as "the principal Act").
(2) This Act shall be deemed to have come into force on the 1st day of April 1972.
Section 4 of the principal Act is hereby amended by -
(a) Omitting from paragraph (a) the word "six" and substituting the word "eight":
(b) Omitting from paragraph (b) the words "five hundred" and substituting the words "two thousand".
Section 5 of the principal Act is hereby amended by -
(a) Omitting from paragraph (a) the words "four thousand" and substituting the words "six thousand five hundred":
(b) Omitting from paragraph (b) the words "two hundred" and substituting the words "one thousand five hundred".
Section 7 of the principal Act is hereby amended by -
(a) Repealing paragraphs (b) and (c) of subsection (1) and substituting a new paragraph as follows:
- "(b) In any place outside the Cook Islands, such sums to cover actual and reasonable expenses as Cabinet shall from time to time determine and such further sums to cover incidental expenses (which shall be non-accountable) as Cabinet shall from time to time determine.":
(b) Repealing subsection (4) (as enacted by paragraph (b) of section 2 of the Civil List Amendment Act 1969) and substituting a new subsection as follows:
- "(4) There shall be payable to each Minister (including the Premier) in addition to the other allowances provided by this section, travelling allowances for such period that the Minister's wife actually accompanies him and where the travel of his wife is authorised by Cabinet, at such rate to cover actual and reasonable expenses as Cabinet shall from time to time determine and to cover incidental expenses (which shall be non-accountable) as Cabinet shall from time to time determine:
- Provided that nothing in this sub-section shall authorise the payment of such travelling allowances on more than one occasion in any period of twelve months except on occasions of attendance at official state functions overseas."
Subsection (1) of Section 10 of the principal Act is hereby amended by -
(a) Omitting from paragraph (a) the words "two thousand five hundred" and substituting the words "five thousand":
(b) Omitting from paragraph (b) the word "one" and substituting the word "five".
Section 13 of the principal Act is hereby amended by omitting the words "five hundred" and substituting the words "two thousand", and adding a proviso to the said section as follows:
"Provided that in the case of any member who votes in the negative on the question put in the Committee of the Whole Assembly "That clause 6 as amended stand part of the Bill" that member shall be paid a salary at the rate of five hundred dollars per annum only."
Section 14 of the principal Act is hereby repealed and the following new section substituted:-
"14. Allowances of members
There shall be payable to each member of the Legislative Assembly an allowance at the rate of five hundred dollars per annum to provide for expenses incurred in connection with his official duties and his duties in connection with the Legislative Assembly."
Section 24 of the principal Act is hereby amended by inserting after the word "enactment" and before the word "shall" the words "and all allowances payable to any member pursuant to section 14 of this Act (as inserted by section 7 of the Civil List Amendment Act 1973)".
