An Act to amend the Criminal Justice Act 1967

BE IT ENACTED by the Parliament of the Cook Islands in Session assembled, and by the authority of the same, as follows:
1. Short Title - This Act may be cited as the Criminal Justice Amendment Act 2000, and shall be read together with and deemed part of the Criminal Justice Act 1967 ("the principal Act").
2. Parole Board - Section 14 of the principal Act is amended by-
(a) repealing paragraph (a) of subsection (1), and substituting the following new paragraph-
"(a) the Chief Justice of the High Court who shall be the Chairperson;"
(b) inserting in subsection (2) after the word "than" and before the words "the Director" the words "the Chief Justice of the High Court and".
3. Deputy Chairperson - The principal Act is further amended by inserting after section 14, the following new section-
"14A. Deputy Chairperson - (1) Notwithstanding section 14 of this Act, a Judge of the High Court other than the Chief Justice, while in the Cook Islands, shall be deemed to be Deputy Chairperson of the Board.
(2) Where the Chairperson is absent from the Cook Islands, the Deputy Chairperson shall act as Chairperson at any meeting of the Board and shall exercise all powers and functions of the Chairperson."
4. Meetings and procedure of Parole Board - Section 16 of the principal Act is amended by omitting the word "Chairman" from subsection (1) and substituting the word "Chairperson".
